What is an
ESTATE PLAN?
An Estate Plan goes beyond a simple Will. When creating your Estate Plan, we take a comprehensive approach, considering both your family dynamics and business structures. We engage in meaningful conversations to understand your priorities and the legacy you wish to leave behind
We conduct a thorough review of your business structures and Family and Unit Trust Deeds to gain a comprehensive understanding of the assets you own and control.
If you have concerns about children who may face challenges—such as a disability, unstable relationships, financial instability, high-risk professions, or difficulties managing wealth due to addiction or other issues—we’ll discuss these with you and recommend the best way to provide for them in your Will. This may involve including Testamentary Trusts, Capital Protective Trusts, or Special Disability Trusts.
For blended families, where you and your partner have children from previous relationships, we work with you to clarify your wishes regarding the distribution of assets you individually own or control. We then help you implement strategies, such as Life Interests or Capital Protective Trusts, to ensure your intentions are clearly documented in your Will.
Superannuation is another key component of an estate plan. We ensure you have a current, valid Binding Death Benefit Nomination and, if applicable, review your SMSF Trust Deed to ensure the nomination is correctly in place according to its provisions
What about if you lose capacity?
While it’s essential to have documents in place that address matters after your death, it’s equally important to consider what happens if you are still alive but become incapacitated and unable to make decisions due to an accident, stroke, or other medical condition.
We’ll discuss the key documents that should be prepared in case you can no longer make decisions for yourself—especially critical if you run your own business.
An Enduring Power of Attorney allows you to designate someone to handle legal, financial, and personal matters on your behalf if you become incapacitated.
Similarly, appointing a Medical Treatment Decision Maker ensures that someone you trust can make medical decisions for you when you’re no longer able to.
Additionally, an Advance Care Directive enables you to clearly outline your medical preferences, specifying which treatments you do or do not consent to, should your Medical Treatment Decision Maker need to act on your behalf.
A comprehensive Estate Plan includes all these elements, providing protection for both your life and your legacy, and offering peace of mind to your loved one

We offer Zoom consultations to discuss your Estate Plan, address your key concerns, and explain the process moving forward. For your convenience, we offer limited evening availability for Zoom consultations. If this option works best for you, please let us know.

After reviewing your completed Estate Planning Fact Sheet, we will get in touch with you to arrange a Zoom meeting to go over your responses and ensure all your concerns are fully addressed.
